This Terms of Service Agreement (the "Agreement") is a legal agreement between you (referred to as "User," "You," or "Your") and Becca Cannon (referred to as "Provider," "We," "Us," or "Our"), governing your purchase and use of a website template (referred to as the "Template") offered by Becca Cannon. By purchasing and using the Template, you agree to be bound by the terms and conditions outlined in this Agreement.

1. License Grant: 1.1. Subject to the terms and conditions of this Agreement, Provider grants You a non-exclusive, non-transferable, revocable license to use the Template for a single website project. 1.2. You may customize and modify the Template to suit Your website project's needs and integrate it into Your own website design.

2. Intellectual Property: 2.1. The Template and all associated intellectual property rights belong to Provider and are protected by copyright laws and international treaties. 2.2. You acknowledge and agree that You do not acquire any ownership rights in the Template or any of its components. 2.3. You may not distribute, sublicense, sell, or lease the Template or any part of it without prior written consent from Provider.

3. Use and Restrictions: 3.1. You may use the Template only for lawful purposes and in compliance with applicable laws and regulations. 3.2. You agree not to: a. Use the Template in any manner that violates any third-party rights, including intellectual property rights. b. Modify, reverse engineer, decompile, or disassemble the Template or any part of it. c. Remove or alter any copyright notices or proprietary markings in the Template. d. Use the Template in a manner that could harm the reputation or integrity of Provider.

4. Support and Updates: 4.1. Provider may provide support and updates for the Template at its discretion. 4.2. Any support or updates provided by Provider are subject to the terms of this Agreement.

5. Disclaimer of Warranty: 5.1. The Template is provided "as is" without warranties of any kind, whether express or implied. 5.2. Provider does not warrant that the Template will be error-free or uninterrupted or that it will meet Your specific requirements. 5.3. You acknowledge that You use the Template at Your own risk.

6. Limitation of Liability: 6.1. To the maximum extent permitted by applicable law, Provider shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use of the Template. 6.2. Provider's total liability under this Agreement shall be limited to the amount paid by You for the Template.

7. Indemnification: You agree to indemnify, defend, and hold harmless Provider from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or in connection with Your use of the Template or any breach of this Agreement.

8. Termination: 8.1. Provider may terminate this Agreement and revoke Your license to use the Template if You breach any terms of this Agreement. 8.2. Upon termination, You must immediately cease using the Template and destroy all copies of the Template in Your possession.

9. Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in [Jurisdiction].

10. No Refunds:

    10.1. All purchases of the Template are final, and Provider does not offer refunds, except as required by applicable law.

    10.2. By purchasing the Template, You acknowledge and agree that You have reviewed the Template's features, specifications, and any available demonstrations or previews to ensure its suitability for Your needs.

    10.3. Provider does not warrant or guarantee that the Template will meet Your specific requirements, and You bear the responsibility for ensuring its compatibility and suitability before making the purchase.

    10.4. In the event that the Template is found to be defective or not as described, You must notify Provider within a reasonable period from the date of purchase. Provider will then evaluate the issue and, at its sole discretion, determine the appropriate course of action, which may include providing a replacement or resolving the issue in another reasonable manner.

    10.5. Any request for a refund due to technical issues or dissatisfaction with the Template will be considered on a case-by-case basis, and Provider's decision will be final.

    10.6. Refunds, if approved, will be issued solely at Provider's discretion and may be subject to applicable processing fees or deductions.

    10.7. You understand that once You have purchased and received access to the Template, Provider has fulfilled its obligations, and no refunds will be provided.

    10.8. This "No Refunds" policy applies to all purchases of the Template, regardless of the payment method or platform through which the purchase is made.

    10.9. By proceeding with the purchase of the Template, You expressly waive any rights to refund, chargeback, or dispute the payment through Your payment provider or any other third party.

    10.10. This "No Refunds" policy does not affect Your statutory rights as a consumer under applicable consumer protection laws.
